1. Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of the theuppr.com website, TheUppr mobile applications, and the TheUppr Quick Buy browser extension (collectively, the "Service"), operated by TheUppr ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Eligibility and Accounts
You must be at least 18 years old to buy or sell on the Service, and at least 13 to create an account for inventory tracking. You are responsible for the accuracy of the information on your account and for keeping your login credentials secure. You are responsible for all activity that occurs under your account.
3. Selling on TheUppr
To sell, you must complete seller onboarding, including identity verification (KYC) required to receive payouts. As a seller you agree to:
- List only authentic items you own and are legally entitled to sell
- Describe each item accurately, including condition, size, and box status
- Honor the sale price and ship promptly once a sale is confirmed
- Cooperate with dispute resolution and authenticity checks
Listing counterfeit, stolen, or misrepresented items is grounds for immediate account termination and may be reported to the relevant authorities.
4. Fees and Payouts
When an item sells, TheUppr deducts a selling fee and applicable payment-processing fees from the sale price. Payouts are held in escrow and released to your connected payout account after the sale is confirmed and any dispute window has passed. Fee rates are shown before you publish a listing and at the point of sale. Payouts are processed by Stripe; you must have a verified payout account to receive funds.
5. Buying on TheUppr
When you purchase an item, you agree to pay the listed price plus any applicable taxes and shipping. Purchases are subject to our Returns & Disputes policy. If you believe an item is not authentic or was materially misrepresented, use our authenticity reporting process.
6. Prohibited Conduct
- Listing counterfeit, replica, or stolen goods
- Circumventing fees or transacting off-platform to avoid buyer protections
- Manipulating prices, reviews, or authenticity signals
- Scraping, reverse-engineering, or abusing the Service or its APIs
- Any unlawful, fraudulent, or infringing activity
7. Intellectual Property
The Service, including its software, design, and content, is owned by TheUppr and protected by intellectual-property laws. You retain ownership of the content you upload (such as photos), and grant us a license to display it as needed to operate the Service.
8. Disclaimers and Limitation of Liability
The Service is provided "as is" without warranties of any kind. Market values, price estimates, and fit recommendations are informational and not guarantees. To the fullest extent permitted by law, TheUppr is not liable for indirect, incidental, or consequential damages arising from your use of the Service.
9. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms. You may close your account at any time via your account settings.
10. Changes and Governing Law
We may update these Terms from time to time and will post the revised version on this page with a new "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance. These Terms are governed by the laws of the United States and the state in which TheUppr is organized, without regard to conflict-of-law principles.
